These Terms of Use (the "Terms") set out the conditions for using the smartphone app "Oshiche" (the "Service") provided by the Oshiche operations team (the "Operator").
Before using the Service, please read the following carefully and use the Service only after agreeing to these Terms.
Article 1 (Purpose and scope)
- These Terms apply to all relations between the Operator and persons using the Service ("Users") in connection with use of the Service.
- The Operator may establish a privacy policy, guidelines, and other rules for the Service in addition to these Terms. Those rules form part of these Terms.
Article 2 (Definitions)
The terms used in these Terms are defined as follows.
- "Service" means an app that allows Users to neatly import instant photos, such as chekis, into their smartphones and manage, view, and adjust them.
- "Credits" means points consumed when using features within the Service, such as uploading and AI enhancement.
- "Subscription plan" means a contract under which Users pay recurring monthly or annual fees to use certain features or credits.
Article 3 (Account registration)
- Persons wishing to use the Service must agree to these Terms and register using the method specified by the Operator.
- The Operator may refuse or cancel a registration in any of the following cases.
- The registration application contains false information
- The applicant has previously been suspended for a violation of these Terms or a similar reason
- Any other case the Operator considers inappropriate
Article 4 (Fees and payment methods)
- Some features of the Service require payment. Users must pay the applicable fees through the payment methods specified by Apple or Google.
- Subscription plans renew automatically at the end of each contract period. Users who wish to stop automatic renewal must complete the procedure in the relevant platform's settings by the renewal deadline.
- Credits purchased on a one-time basis become available immediately after purchase and are nonrefundable.
- If paid credits are consumed in error for reasons attributable to the Operator, the Operator will consider restoring the credits or refunding an equivalent amount.
Article 5 (Refunds and cancellations)
- As a general rule, fees paid by Users are nonrefundable.
- Exceptions apply where a refund is required by law or specifically approved by the Operator.
- Refunds for purchases made through Apple or Google are subject to the respective company's terms.
Article 6 (Prohibited conduct)
Users must not engage in any of the following conduct when using the Service.
- Conduct that violates laws or public order and morals
- Conduct that infringes others' rights, including copyright, portrait rights, and privacy
- Unauthorized access, analysis, modification, copying, redistribution, or similar conduct
- Conduct that places an excessive load on servers
- Conduct that damages the reputation of the Operator or a third party
- Any other conduct the Operator considers inappropriate
Article 7 (Rights in content)
- Copyright in images and data uploaded by Users to the Service belongs to the Users or other lawful rights holders.
- However, Users grant the Operator permission, without charge, to use this data, including copying, analysis, and temporary storage, to provide, improve, and verify the operation of the Service, among other such purposes.
- If copyright or other rights arise in results produced by AI automatic adjustment or enhancement ("Generated Content"), those rights belong to the User. However, Users must resolve, at their own responsibility and expense, any issues with third parties arising from the use or publication of Generated Content.
Article 8 (Suspension, changes, and termination of the Service)
- The Operator may suspend or change all or part of the Service without prior notice to Users in the following cases.
- When performing system maintenance or inspections
- When provision of the Service becomes difficult due to fire, power outages, natural disasters, or similar circumstances
- Any other case the Operator considers necessary
- The Operator bears no liability for any damage suffered by Users as a result of suspensions or changes under the preceding paragraph.
Article 9 (Account suspension and deletion)
- The Operator may suspend or delete an account without prior notice if it determines that a User falls under any of the following cases.
- The User has violated these Terms
- The User has used the Service for an improper purpose
- Any other case the Operator considers inappropriate
- Deletion of an account does not extinguish the Operator's rights and obligations concerning past use.
Article 10 (Disclaimer of liability)
- The Operator does not guarantee the completeness, accuracy, usefulness, or similar qualities of the Service.
- Users use the Service at their own responsibility, and the Operator bears no liability for damage resulting from its use.
- The Operator will not become involved in disputes between Users or between Users and third parties.
Article 11 (Changes to the Terms)
- The Operator may change these Terms as necessary.
- Changes to the Terms take effect when posted within the Service or on the official website.
Article 12 (Governing law and jurisdiction)
The interpretation and application of these Terms are governed by Japanese law. The Tokyo District Court has exclusive jurisdiction by agreement as the court of first instance over disputes relating to the Service.
